If found responsible for the civil citation, the Court will notify the Motor Vehicle Department (“MVD”) of the civil conviction, in turn, the MVD will assess points to your license and other possible penalties, such as traffic survival school or suspension. Whether points are assessed to your license depends on the nature of the civil traffic violation. Lastly, many are also surprised to find that the cost of insurance can increase with an assessment of points on their home-state drivers license as most insurance companies check the driving histories of their applicants. Some civil violations are: Speeding or Photo Radar; Unsafe Lane Change; Failure to Remain in Lane; Crossing the Gore Area; HOV Lane Violation; Following to Closely; Improper Turns; Red Light Violation; and Failure to Yield. Criminal Traffic Violations
With a criminal infraction, possible fines, assessment of points to your home-state license, and criminal misdemeanor could be placed on your record. Also, if you have been charged with a criminal traffic violation, you will not be eligible for Defensive Driving School. When charged with a criminal traffic violation, the process becomes more complicated than a civil traffic violation. The Court can and does require that defendants appear at their hearings, or else a warrant will be issued for arrest as well as the suspension of driving privileges.
